With the legalization of mushrooms and other plant medicines on the horizon, people are seeking out more ways to experience these drugs. 3Amigos are turning to edibles to mask the mushrooms’ earthy flavor, which is often compared to dirt, and to make the experience more pleasant for those who might be reluctant to take on the trip without some help. The result is a growing market for psilocybin mushroom products that are blended into chocolate, gummies and tea.

Psychedelics can cause a wide range of psychological and physical effects, depending on the drug and the dosage. These can include hallucinations, feelings of euphoria or anxiety, and altered perceptions (carhart-harris & friston, 2020). Some people also have spiritual experiences during psychedelic use. Studies suggest that psychedelics can lead to changes in one’s mental schemes, such as shifting from a materialist or physicalist worldview to a more panpsychistic one.

While psilocybin-containing magic mushrooms are still a Schedule 1 substance, other fungi, such as Amanita muscaria, commonly known as fly agaric mushrooms, produce a similar effect and can be legally purchased at a number of CBD and plant wellness stores. Unlike psilocybin, though, they don’t contain the banned substance psilocin.

Because of this, they can be more readily available and are a safer alternative to psilocybin. However, consuming them comes with its own risks and should only be done in a safe and controlled environment, such as a home with familiar friends or family members. In a sale and leaseback arrangement, the seller-lessor retains legal title to the asset. However, the transaction may also contain a right-of-use interest in the underlying asset. It is important to evaluate whether this right-of-use is in place and that control has transferred. See RR 8.7 for guidance on this evaluation.

Some sale and leaseback transactions contain a put option for the buyer-lessor to repurchase the asset at a specified future date. These put options must be evaluated to determine if the transfer is a sale, and thus not reportable as a lease. An analysis should include an assessment of whether the buyer-lessor has a significant economic incentive to exercise the put option, and whether the repurchase price is expected to significantly exceed the market value of the asset at the time of repurchase.
